Terms and Conditions for Maintenance Service

1. PERIOD OF AGREEMENT
This Agreement shall start on the Commencement Date and shall continue in force initially for the Term of one year and may be terminated by either party giving not less than ONE MONTH'S PRIOR WRITTEN NOTICE to expire after the initial term has elapsed PROVIDED ALWAYS THAT the Customer shall be entitled to terminate this Agreement at any time on vacation of the premises by giving the Service Contractor ONE MONTH'S PRIOR WRITTEN
NOTICE.

2. SERVICE CONTRACTOR
(a) Undertakes to service the heating unit including visually checking oil storage tank and gauge, the oil line and fire valve and to check correct operation of boiler electrical controls. Also to inspect the fan and air filters on air heating systems as detailed in the appropriate schedule. To clean boiler flueway and fluepipe only where and as far as it is accessible with 4ft flue brush, but not sweeping chimney. Provided that the Contractor on inspection of the boiler and flue installation at any time finds it to be such a unit that it can be satisfactorily maintained in accordance with the manufacturer's recommendations.

N.B: The contractor accepts no responsibility for failure of the tank, its supports or oil lines, loss of oil or consequential damage arising therefrom. However such failures/losses may be covered by a property insurance policy; advice on which should be sought from your insurance company.

(b) It is recommended that flexible oil lines are replaced biennially or as required with the exception of some appliances ie cookers, where replacement is generally more frequent; nozzles annually or as required; filters at every service or as required, and ignitors (where appropriate and if available) six monthly.

N.B: All parts are chargeable.

(d) The Contractor shall carry out such services during his normal working hours, Monday to Friday excluding Bank Holidays. We endeavour to keep all appointments as arranged. Unfortunately very occasionally a visit has to be deferred. We regret any inconvenience should a cancellation occur. However we are unable to offer any form of compensation.

(e) Additional emergency visits may be called for in the event of failure of the equipment covered by the Agreement. The Contractor shall endeavour to make such emergency visits within 24 hours or as soon as reasonably practicable within the normal working day hours. The Contractor upon receiving Notice from the Customer of a heating fault will dispatch an Engineer as soon as circumstances permit to investigate and if possible rectify.

(f) The Contractor cannot accept responsibility for the non availability of spare parts from recognised suppliers, or as a consequence thereof or for any other reason for recompense in the event of any delay to rectify a boiler or system failure. The Contractor cannot be bound to acquire by purchase such parts and materials from other suppliers. Team Energy will normally only fit spares supplied by them.

(g) In the event of the non-availability of "new" spare parts the contractor is not agreeable to supply or fit "reconditioned" spare parts nor accept responsibility for such parts fitted by others.

(h) Estimate of cost of replacement parts available on request.

(i) The cost of parts is based on our retail price which generally is in line with suppliers' retail prices.

(j) Until paid for the property in all goods supplied or installed shall remain with the company but the goods shall be at the buyer's risk.

(k) Consideration to replacing an older unit with a new boiler should be given before agreeing to the replacement of any parts. Regrettably in the event of several parts failing and being replaced over a short period of time we would not be able to remove parts to offset against the cost of a new boiler.

(l) There will be no discretionary financial consideration for parts failing outside the recognised guarantee period UNDER ANY CIRCUMSTANCES.

3. EXCEPTIONS
(a) The Customer accepts responsibility for ensuring that the installation and its use always comply with all relevant statutes, bye-laws and regulations.

(b) The customer agrees to indemnify the Contractor against any claim or claims arising in connection with the heating installation other than any claim occasioned by the negligence or default of the Service Contractor.

(c) The Agreement does not cover the maintenance or repairs to boiler heat exchanger, (including safety valve) flues, radiators, ducting, pipework, valves, fuel tanks, humidifiers, motorised valves and other ancillary equipment or chimney sweeping.

(d) Any insurance policy taken out is in addition to any charges levied by Team Energy. All invoices are payable on receipt and it is the responsibility of the customer to submit any insurance claim direct to their insurers. No correspondence will be entered into regarding non payment of any insurance claim. Details of the insurance schemes are available on request.

(e) The choice of any insurance policy is the sole responsibility of the proposer. Prior to signing the proposal form, any queries concerning cover or future claims must be clarified directly with the brokers. Team Energy will not offer any specific recommendations as to the suitability of any policy nor accept any responsibility for any liabilities which are not covered by an insurance policy.

(f) Replacements for manufacturers' "in guarantee" parts on boilers/equipment not installed by Team Energy are not covered by this agreement. Such requirements and attention required for a malfunction during the boiler/equipment guarantee period should be referred back to the installer or the manufacturer as any call made or parts fitted by Team Energy will be chargeable.

4. VARIATION OF CHARGES
From time to time and at any time Team Energy may vary the charges enclosed with this agreement provided that if this right is exercised and any charge is increased the Customer may terminate this Agreement upon the expiry of one month's written notice given by the Customer to the Contractor. See enclosure detailing current servicing and contracted emergency rates subject to review usually annually, notification of which is available on request. Any additional work to the service schedule will be charged labour plus parts. Emergency breakdown visits and all spare parts to be charged at the appropriate current rates applicable at the time of carrying out such services.

5. PAYMENT
The Customer agrees to pay charges under this Agreement so that they are received by the Contractor not later than the 15th day of the month following the month in which the service charges relate.

If the Customer fails to make such payment within the Terms, the Company shall not be obliged to make any further visit or visits (of whatever nature) until such payment has been made.

Breakdown charges and cost of all spare parts are payable on receipt of invoice.

6. ASSIGNMENT
(a) Any previous service agreement between the customer and the Service Contractor shall be deemed 'terminated' on the commencement of this Agreement.

(b) This Agreement shall not be assigned or transferred in whole or in part by the customer directly or indirectly without prior written consent of the Service Contractor.

7. FORCE MAJEURE
The Contractor shall not be responsible for any failures to fulfil any Terms of this Agreement if fulfilment has been delayed or prevented by any strike or industrial dispute thereof or compliance with any Government Order or restriction or any other circumstances whatsoever not reasonably within the control of the Contractor.
